Terms of Service

Please read these Terms of Service ("Terms") carefully before using NurseClock ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

NurseClock is a mobile application designed to help nurses and shift workers manage alarm schedules. The App allows you to create, customize, and manage alarms; import shift schedules from calendar services; configure alarm sounds and snooze settings; and optionally enable automatic calendar synchronization ("auto-sync") that keeps your alarms up to date with your shift schedule. NurseClock is independently developed and maintained.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

3. User Responsibilities

When using NurseClock, you agree to:

Use the App only for its intended purpose of alarm and schedule management.
Ensure your device settings (volume, Do Not Disturb, battery optimization) are configured properly for alarms to function.
Maintain a backup alarm method for critical shifts or appointments. The App is a scheduling tool and should not be your sole method of waking for important obligations.
Not attempt to reverse engineer, decompile, or disassemble the App.
Not use the App for any unlawful purpose.

If you enable auto-sync, you additionally acknowledge and agree that:

The App is authorized to automatically add, update, and remove alarms based on changes detected in your calendar feed, without requiring manual confirmation for each change.
You are responsible for the accuracy, availability, and security of any calendar URL you provide to the App.
You should periodically verify that imported and auto-synced alarms are correct, as the App depends on third-party calendar services for data accuracy.
You can disable auto-sync at any time from within the App to stop automatic alarm modifications.

4. Subscriptions and Purchases

NurseClock offers a premium subscription ("NurseClock Pro") that unlocks additional features. All alarm sounds are currently available for free. Subscription options include monthly, yearly, and lifetime plans.

All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.
Subscription payments are charged to your Apple ID account upon confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions.
Refunds are handled by Apple in accordance with their refund policy. We are unable to process refunds directly.

5. Intellectual Property

The App, including its design, code, features, and original content, is the intellectual property of NurseClock and its developer, and is protected by applicable copyright and intellectual property laws.

NurseClock includes alarm sounds sourced from royalty-free libraries, including Mixkit (mixkit.co) and Zedge (zedge.net), used in accordance with their respective free-use license terms. These sounds are provided for personal, non-commercial use within the App. Alarm sound display names within the App are descriptive labels chosen for user convenience and do not imply any affiliation with, endorsement by, or association with any third-party brand, manufacturer, or platform.

You may not reproduce, distribute, modify, or create derivative works from any part of the App without prior written permission.

6. Alarm Reliability and Auto-Sync Disclaimer

NurseClock is designed to deliver reliable alarms, but alarm delivery depends on factors beyond our control, including but not limited to:

Device settings (Silent Mode, Do Not Disturb, Focus modes, volume levels)
Battery level and power-saving modes
Operating system updates or restrictions
Device hardware and performance
Background app restrictions imposed by the operating system

If you use the auto-sync feature, alarm accuracy also depends on additional factors beyond our control, including but not limited to:

Availability and uptime of the third-party calendar service you connect to
Accuracy and format of the calendar data provided by the third-party service
Changes to the calendar service's URL structure or feed format
Network connectivity on your device
iOS Background App Refresh being enabled for the App and the frequency at which iOS schedules background fetches

NurseClock is a scheduling tool and is not a substitute for professional responsibility. We strongly recommend maintaining a backup alarm method, especially for critical shifts. We are not responsible for any consequences resulting from missed, delayed, incorrectly synced, or automatically removed alarms.

7. Third-Party Calendar Services

The App allows you to connect to third-party calendar services (such as NurseGrid) by providing calendar feed URLs. By using these features, you acknowledge and agree that:

We are not affiliated with, endorsed by, or partnered with any third-party calendar service provider.
We are not responsible for the accuracy, availability, completeness, or reliability of data provided by third-party calendar services.
If a third-party calendar service changes its URL format, discontinues its service, or becomes otherwise unavailable, the calendar import and auto-sync features may stop functioning for that service.
Your use of third-party calendar services is subject to the terms and privacy policies of those services.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THAT AUTO-SYNC WILL ALWAYS ACCURATELY REFLECT YOUR CURRENT SCHEDULE OR THAT THIRD-PARTY CALENDAR DATA WILL BE CORRECT OR AVAILABLE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NURSECLOCK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF INCOME, MISSED SHIFTS, LOSS OF EMPLOYMENT, OR ANY OTHER DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM INCORRECT, MISSED, OR AUTOMATICALLY MODIFIED ALARMS RESULTING FROM THE AUTO-SYNC FEATURE OR THIRD-PARTY CALENDAR DATA.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP OR ANY IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to terminate or restrict your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the App at any time by deleting it from your device.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved in the courts of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected in the App and on this page with an updated effective date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
